Saturday, August 14, 2021 - More than $7 million has been awarded to plaintiffs that have suffered severe injuries from Bard's IVC blood clot filter after filing a Bard IVC filter lawsuit. The IVC filter is inserted into the interior vena cava, the major artery leading to the heart and lungs, and to trap blood clots before they can reach the heart. The medical device is designed to be removed at regular intervals and cleaned, then reinserted. Hundreds of individuals have experienced severe injuries as a result of the device malfunctioning and failing to perform as advertised. PR Newswire describes the ways the faulty medical device has failed plaintiffs. "The spider-shaped devices are known to tilt, perforate vein walls, and fracture, causing metal pieces to dislodge and migrate into internal organs and other structures in the body. In the Dallas case, jurors found that Bard's Recovery IVC filter caused serious medical complications when it fractured after being implanted. The verdict includes $386,250 in damages." One lawsuit awarded a plaintiff more than $3 million. Attorneys for Bard, the IVC filter's manufacturer disagreed with the jury's verdict but was pleased the damages were limited to compensatory. The company continues to tell reporters that their devices have been approved by the Food and Drug Administration (FDA) and save lives.

An IVC filter is an anti-blood clot device that should be used only as a last resort when chemical blood thinners no longer work or can not be tolerated by the patient. Recent studies have shown that the device may not work in a high percentage of patients. According to PurdueandKidd.com (PK), they do more harm than good and should not have been on the market. When a Bard IVC filter fractures and penetrates through the artery, the pieces become hard to find and impossible to retrieve without open-heart cavity surgery. The longer the device remains in the body, the greater the risk it may fracture. Doctors are hesitant to attempt to retrieve it for cleaning for fear the device could break apart. About 12% of Bard's IVC filters fail within 5.5 years, according to PK.

The Bard IVC filter joins thousands of other medical devices that the FDA failed to test before allowing them on the market. Bard IVC filters were rushed to market using the faulty FDA 501k system. Under the 501k system, all a medical device company must do is convince a panel of experts that the device is substantially similar to one already on the market, even if the target device has been recalled or the subject of lawsuits. The FDA's inadequate fast-track medical device approval system was featured in the Netflix documentary "The Bleeding Edge," where IVC filters contrasted with polypropylene hernia repair mesh, transvaginal support mesh, and Essure Birth Control Coils as being the subject of thousands of patient complaints.
