Monday, October 25, 2021 - The FDA has made two official Bard IVC filter warnings in the decade since the device was initially approved. Cases involving the Bard IVC filter fracturing, migrating and injuring a patient rest on whether or not Bard sales representative oversold and failed to warn physicians of the risks of using the device. In the first Bard IVC fracture lawsuit that was decided in 2018, a woman was awarded $2 million for the injuries she sustained from Bard's failure to warn her about the dangers of the medical device. The plaintiff's attorney told the press "she believes the most important factor in the jury's determination that punitive damages are due was Bard's failure to tell physicians what they knew about the failure of the product they were marketing and selling," according to DrugWatch.com. The medical device fractured inside the patient's artery and pieces eventually made their way to her heart, implanting themselves permanently. The woman, as do potentially other Bard IVC filter patients, now lives in the constant fear the IVC filter fragment could break free and cause a heart attack and instant death. The woman's open-heart surgery determined the IVC filter fragments were irretrievable. To make matters worse, plaintiff attorneys think that severe IVC filter complications can occur if doctors that perform open-heart surgery fail to find and remove IVC filter fragments may be unaware that they walk around with the metal shard stuck in or close to their heart and that they could die at any time. The plaintiff's attorney said: "There are so many other people out there that may not have any idea they have a piece of this filter in their heart or lung or some other vital organ."

It has been revealed in court that a physician has confidence in choosing a particular model of Bard IVC filter based on the understanding of the features of the device and the relative safety of using it. As it turns out, doctors often consider the age of a patient and recommend a temporary, replaceable filter in younger patients whose prognosis is for their blood-clotting condition to improve in the foreseeable future. The replaceable filter used for younger patients is lighter and more apt to fracture into pieces within the artery, and pieces of it are free to travel to the lungs or heart, causing permanent injury or death. A permanent filter may be more preferable for an older patient because the objective could be to extend life for only another ten to fifteen years, up to the normal life expectancy. A permanent filter is sturdier and will not be subject to the stress of yanking and pulling that could be required during the removal process. Leaving an ICV filter in a patient for more than a year or two could lead to the device capturing so many blood clots that it could itself become the source of blood clots. If an IVC filter is left in place for more than one year it could become encapsulated in scar tissue and impossible to remove without using force.
