Monday, November 1, 2021 - IVC filter patients have filed lawsuits against Bard for rushing to market a faulty medical device without testing it. Plaintiffs allege that the device's fundamental design flaws have led to their injuries. Approximately 9000 IVC filter complication lawsuits await Bard for bringing an allegedly faulty medical device to market, one full of life-threatening design flaws. The IVC filter must be delicate and flexible enough to exist within the inferior vena cava, the artery leading to major organs. It also must be strong enough to trap and hold blood clots against the tide of blood that will constantly flow past it. Once the strength and flexibility problem is solved, the next issue will be what material to make the device from and whether or not the human body's immune system will attack it and dissolve it and the tissues around it into mush. The IVC filter construction must be flexible enough to absorb any blow from the outside without fracturing the device or sending the device through the IVC, penetrating it, and then being free to migrate to other parts of the body. Plaintiffs have been awarded more than $9 million in Bard IVC filter lawsuits that allege the device broke into pieces during the removal surgery and the pieces became lodged in the heart or lungs. Bard, the maker of the IVC filter defend the device by saying that all of the criteria above have been met and that the FDA has approved the device, but that is not saying much. The IVC filter was approved via the FDA's flawed 501 k fast-track approval system, where potentially life-saving medical devices are little more than rubber-stamped to market. All a medical device like the IVC filter has to prove is that it is similar to another medical device that has already been approved, regardless of whether that target device has been recalled or the subject of personal injury lawsuits. The FDA relies on reports made to their MAUDE database from surgeons and patients to report defects in the device, and only then does the FDA take a deeper look.

The IVC filter design concept of trapping blood clots permanently in the artery does not take into account that the device will eventually fill up and need to be removed and replaced, or else it will become the source of the blockage. It could take a month or a year for the filter to fill up, and there is no way to evaluate the device's status while it is in place. Also, the IVC filter is nearly impossible to remove by minimally invasive laparoscopic surgery like the type used to insert it because the filter becomes embedded in scar tissue over time. The IVC filter becomes encased within scar tissue within the inferior vena cava like the Essure birth control coils became encased in scar tissue within a woman's Fallopian tubes, creating scar tissue, and blocking sperm from reaching the eggs. The maker of Essure has been forced to pay billions of dollars to women who have been injured by the Essure birth control device. How is the IVC filter any different? Both create sufficient irritation while in place to cause scar tissue to encapsulate it and also elicit an autoimmune response from the body.
